Foxy Foldaway Terms & Conditions

1. Orders and Sales

  • Placing Orders:
    • Users may place electronic orders for available products.
    • Orders are subject to product availability.
  • Contract of Sale:
    • A sales contract is formed upon successful order placement and full payment processing.
    • Foxy Foldaway must recieve and accept the payment.

2. Payment

  • Payment Failure:
    • Unsuccessful payments due to account issues, insufficient funds, or incorrect details will result in order cancellation.
    • Product availability is not guaranteed in the event of payment failure.
  • Electronic Funds Transfer (EFT):
    • Orders are processed upon receipt of proof of payment.
    • Orders placed outside business hours are processed on the next business day.

  • Cash Deposits:
    • Users are responsible for bank charges associated with cash deposits.
  • International Payments:
    • Users are responsible for all bank charges incurred for international transfers.

3. Product Availability and Reservation

  • Product Reservation:
    • Products cannot be reserved for later purchase.
    • Adding items to the cart does not guarantee reservation.
  • Stock Availability:
    • If an order cannot be fulfilled due to stock unavailability, a reimbursement or credit note will be issued.
    • New stock is subject to price changes without prior notification.

4. Returns and Refunds Policy

4.1 General Returns (Change of Mind)

In accordance with the Electronic Communications and Transactions Act (ECTA), customers have a 7-day “cooling-off” period for goods purchased online.

  • Shipping Costs: For “Change of Mind” returns, the customer is responsible for the original delivery fee and the cost of returning the goods to our facility.
  • Condition: Goods must be returned in their original, unopened packaging.
  • Handling Fee: A 10% to 20% handling/restocking fee may be applied if the goods are returned disassembled, with open internal packaging, or show signs of attempted installation.

4.2 Defective Goods & Implied Warranty (CPA Section 56)

All FoxyFoldaway products carry an implied 6-month warranty against manufacturing defects.

  • The Inspection Process: We reserve the right to conduct a Technical Inspection of any returned goods before a refund, repair, or replacement is finalized. This process typically takes 3 to 5 business days from receipt of the goods.
  • Exclusions: This warranty does not cover damage resulting from:
    • Installation contrary to the provided Installation Guide.
    • Mechanical over-tensioning or “over-tightening” of lines.
    • Use of the product for purposes other than its intended design.
  • Tacit Acceptance: The act of drilling, mounting, or installing the unit to a structure constitutes a tacit acceptance of the components (brackets, screws, plugs) as supplied. Claims for “missing parts” or “incorrect sizes” will not be entertained once the unit has been mounted.

4.3 Reporting Incomplete Orders

Customers must report any missing components or “short-supplies” within 48 hours of delivery and prior to attempting installation.

  • Our products utilize a “Soft-Assembly” Quality Control protocol (where components are pre-joined). Disassembling these kits and then claiming missing parts will result in a deduction from any potential refund to cover the cost of missing items.

4.4 Refund Procedure

  • No “Refund on Collection”: No refunds will be issued at the point of courier collection or prior to physical inspection.
  • Processing Time: Once the Technical Inspection is complete and a refund is approved, funds will be transferred via EFT within 5 business days.
  • Transaction Fee Charges: Any refund is subject to the deduction of any transaction fee charged by a 3rd Party in processing the transaction.
  • Delivery Timeframe:
    • Delivery is estimated at 2-5 days from order receipt.
    • Users will be notified of delivery delays via email or by the courier.
  • Returns:
    • Refunds for returned items will be issued, less delivery and return shipping costs.

5. General Conditions

  • Service Disruption:
    • Foxy Foldaway reserves the right to limit or discontinue website functionality.
    • Website unavailability may occur, potentially causing data loss.
    • Foxy Foldaway is not liable for cross browser incompabilities. Reccomended browsers are Google Chrome, Safari, and Firefox.
  • Intellectual Property:
    • Foxy Foldaway and vendors retain all rights to services, listings, information, images, videos, and databases.
    • Unauthorized modification, reproduction, or distribution is prohibited.
  • Data Protection:
    • Refer to the Privacy Policy for information on user data protection.
  • Order Cancellation and Fraud Prevention:
    • Foxy Foldaway reserves the right to cancel orders suspected of fraud.
    • Verification may be required, including identification or credit card details.
    • Foxy Foldaway may refuse refunds based on suspected fraudulent activity.
  • Changes to Terms and Conditions:
    • Foxy Foldaway reserves the right to revise these terms.
    • Continued use of the service implies acceptance of revised terms.
    • Acceptance of terms is required with each transaction.
  • Right to ban users:
    • Foxy Foldaway reserves the right to ban any user or website domain from use of the service.
